Terms of Service

Please read these Terms of Service ("Terms") carefully before using HabitTracker ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using HabitTracker, you agree to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Age Requirement

HabitTracker is designed to be safe for users of all ages. The App does not collect personal information and stores all data locally on your device. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

3. Description of Service

HabitTracker is a mobile application that helps you build and maintain daily habits. The App requires iOS 18 or later. Features include:

• Creating habits with customizable day-of-week schedules
• One-tap daily habit completion tracking
• Visual calendar showing your progress (color-coded for completed, today, and missed)
• Push notification reminders for your habits
• Monthly progress tracking

All features are currently free. Pro features may be added in a future update.

4. Local Data Storage

HabitTracker stores all data locally on your device using SwiftData. No account creation is required. Your data is not synced to any cloud service and remains entirely under your control.

5. Future Subscriptions

HabitTracker may offer premium features through an auto-renewable subscription in the future. If subscriptions are introduced:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• Any unused portion of a free trial period will be forfeited when purchasing a subscription

6. Acceptable Use

You agree not to:

• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to circumvent any security features of the App
• Use the App for any illegal purpose
• Distribute or share modified versions of the App

7. No Third-Party Services

HabitTracker does not use any third-party backend services. The App operates entirely on your device. The only external service involved is Apple's notification system for push reminders, which is governed by your agreement with Apple.

8. Intellectual Property

The App, including its design, features, and content, is owned by me and protected by intellectual property laws. You retain ownership of your habit data.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, either express or implied. I do not guarantee that the App will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.

11. Changes to Terms

I reserve the right to modify these Terms at any time. I will notify users of significant changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

You may stop using the App at any time by uninstalling it. Uninstalling the App will delete all locally stored data.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

14. Apple App Store Terms

The following terms apply to your use of the App through the Apple App Store:

• These Terms are between you and me, not Apple. I am solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support services for the App.
• Apple is not responsible for any product warranties, whether express or implied. I am solely responsible for any claims relating to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, or claims under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any intellectual property infringement claim.
• You must comply with any applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

15. Your Data Rights

Since all data is stored locally on your device, you have complete control over your data. You can delete individual habits within the App or delete all data by uninstalling the App. See my Privacy Policy for more details.
